This Privacy Policy explains how Clayshot Pro (“we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with Clayshot Pro (the “Service”), including our website at https://clayshotpro.com, our applications, and any related software or features. 1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of Clayshot Pro, including our website at https://clayshotpro.com, applications, and related software and features (collectively, the “Service”), provided by Clayshot Pro (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Accounts

You may need to create an account to use certain features. You agree to provide accurate and complete information, to keep it up to date, and to maintain the confidentiality of your credentials. The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by Clayshot Pro or its licensors and is protected by intellectual property and other laws. Except for the limited license granted in these Terms, no rights are transferred to you. “Clayshot Pro” and associated marks are trademarks of Clayshot Pro, and you may not use them without our prior written permission.

7. Payment, Subscriptions, and Refunds

If the Service includes paid features, you agree to pay all applicable fees as described at the point of purchase. Fees may be billed on a one-time or recurring (subscription) basis. Recurring subscriptions renew automatically unless cancelled before the renewal date. Except as required by law or expressly stated, fees are non-refundable. We may change pricing prospectively with notice as required by law.

The Service may integrate with or link to third-party products and services. We are not responsible for third-party content, products, or practices, and your use of them is governed by their own terms.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY RESULTS OBTAINED WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Clayshot Pro AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) CAD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Clayshot Pro and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. You may stop using the Service at any time. Upon termination, the license granted to you ends, and provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to the Service and Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time; when we do, we will revise the “Last Updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Alberta, Canada, without regard to its conflict-of-laws principles. You agree that any dispute will be resolved in the courts located in Alberta, Canada, and you consent to their jurisdiction.

15. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Clayshot Pro regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
